Commentary by Attorney Michael Grossman
People often see pedestrian accidents and assume it all comes down to who had the right-of-way. Things aren’t always so simple. More often, investigators will seek to determine how avoidable the collision was. Obviously, a pedestrian crossing where there isn’t a crosswalk would be a problem. But if, for example, that person is clearly visible and far away enough to avoid, a driver has a responsibility to avoid them. They don’t get a free pass to hit someone just because they have the right-of-way. If there wasn’t enough time to see and avoid them, though, then it would be ridiculous for a driver to be in trouble for that. So, did authorities work to determine how avoidable this collision was?
