However, making that assumption without a thorough investigation could mean overlooking other contributing factors. That’s why it’s important to ask the right questions to ensure all possible causes are fully examined.

First, did the authorities conduct a thorough investigation? Pedestrian accidents often involve limited witness testimony, especially at night, so a proper investigation should consider all available evidence. Did investigators document the lighting conditions and visibility at the scene? Were there any nearby traffic signals, crosswalks, or signage that might have played a role? Without clear answers, it’s difficult to know if the pedestrian had a fair chance to assess oncoming traffic.

Second, has anyone looked into whether a vehicle defect played a role? While a driver’s account may suggest the pedestrian failed to yield, it’s also possible that the driver’s ability to react was hindered by a mechanical failure.
