Commentary by Attorney Michael Grossman

When it comes to pedestrian accidents, things aren’t often as simple as people think. Right of way is always important to look into, but it’s usually just one possible factor.

What about road conditions? Lighting and visibility? Signage and road design? Alcohol or possible medical conditions? Distraction or speed? These can all lead to serious pedestrian accidents, yet authorities tend to overlook all but the most common possible factors.

That’s why it’s best to take early details like these with a grain of salt. That, and keep in mind that there usually needs to be a careful and extensive accident reconstruction to conclude any serious accident, pedestrian or not.
