Commentary by Attorney Michael Grossman

Pedestrian accidents often get brushed aside because they think the rules are all straight-forward. In reality, all accidents can present unique challenges. Is this a stretch of road that’s dangerous for pedestrians? Was alcohol a factor in the accident? Was the pedestrian clearly visible and avoidable? Have authorities looked for any nearby security cameras? Instead of focusing solely on who had the right-of-way (important as that it), investigations need to be able to paint a complete picture of who all of this could have been avoided. Otherwise, something important could slip through the cracks.
