Commentary by Attorney Michael Grossman

Many people expect police investigations to answer all their questions. Particularly in drunk driving crashes, that doesn’t always happen. If that’s indeed what happened here, then it raises some important follow-up questions. Chief among them: Was the alleged drunk driver over-served by a negligent alcohol provider?

A lot of times, when someone is charged with intoxication assault, that person didn’t become intoxicated in isolation. They were possibly drinking at a bar or restaurant shortly before the crash. That matters because under Texas law, it’s unlawful for alcohol providers to serve someone who’s obviously intoxicated. When they break that rule and someone gets hurt as a result, those providers can be held accountable for their role in the accident.

Unfortunately, investigations too often begin and end at the crash scene. It’s far less common for authorities to take the next step and look into where the alcohol came from. But that step is essential—not just for getting the full truth, but also for preventing future crashes. Have authorities looked into that here?
