When a pedestrian is struck and killed by an alleged drunk driver, it raises serious questions not only about the immediate actions of the driver but also about how that driver became impaired in the first place. In this case, authorities say the driver was intoxicated when she struck and killed a man walking near Menchaca Road and Davis Lane. If that’s accurate, the next important question is: Where did she obtain alcohol before the crash?
Under Texas law, bars, restaurants, and other alcohol providers are prohibited from serving someone who is obviously intoxicated. If the driver had been drinking at an establishment prior to the incident—and that establishment continued to serve her despite clear signs of impairment—it could share responsibility under Texas dram shop law. These laws exist to help prevent situations where unsafe alcohol service leads to harm in the community.
The driver may face criminal charges, but if an alcohol provider contributed to her impairment, that provider should also be held accountable. Identifying all responsible parties, including any establishment that overserved her, is an important part of a complete investigation. Without that accountability, there’s little deterrent for businesses that fail to follow the law.
