Commentary by Attorney Michael Grossman
Over the years I’ve noticed that many people tend to write off accidents like this one, assuming that if the pedestrian wasn’t in a crosswalk then he was at fault. In truth, things are rarely that simple. There could always be extenuating circumstances, and those need to be investigated even if only to rule them out as factors. Is there insufficient lighting in that area? Are there a lot of accidents there? Where was the victim before running across the road that night? Did he notice the car coming? If not, why not? Was the driver’s full attention on their surroundings? Why did the second driver flee after hitting the victim? Did anyone else see what happened? Will anyone gather electronic data from nearby cameras, the car’s black box, or the victim’s phone to see if they have any insights?
The goal of these and other questions isn’t complicate things, but rather to clarify them. In the end investigators might find there’s a simple explanation for this incident, but I think most would agree that it’s important to be sure the whole story is learned. The victim’s loved ones deserve no less, so I hope someone will make sure their questions are answered.
