South Padre Island, TX — May 19, 2024, a pedestrian sustained injuries following a car accident at around 12:25 a.m. along Padre Boulevard.

According to officials, the accident happened in the area of the Padre Boulevard and West Georgia Ruth Drive intersection.

Investigators said that a 30-year-old man was walking eastbound and attempting to cross Padre Blvd. at the time. While doing so, it appears a southbound Jeep Cherokee struck the man, resulting in serious injuries. Additional details are unconfirmed right now, and it’s unclear if any charges were recommended.

With pedestrian accidents, people tend to think it’s all about who had the right-of-way. As important as that is, it’s just one factor to consider. There’s still a basic duty motorists have to avoid reasonably avoidable accidents. If, for example, someone is in the road but clearly visible and far away enough to avoid, a driver doesn’t get to hit them just because they have the right-of-way. That would be ridiculous.

So with a situation like this, it’s important that accident reconstructionists are able to know who was where when the collision occurred, what visibility conditions were, and whether or not the collision was reasonably avoidable. If it wasn’t, obviously it would be unreasonable to hold a driver accountable for something they had no control over. But if it was avoidable, it’s important to bring to light the evidence that proves that.
