Authorities said in preliminary statements that the accident happened at the intersection of Mason Road and Cimarron Parkway.

According to officials, a 31-year-old man was on foot in the area of northbound Mason Road. While there, a Mercedes-Benz struck the pedestrian, resulting in serious injuries to the pedestrian.

How Did This Accident Occur?

When people see a vehicle strike a pedestrian on a city road, one question usually springs to mind: Who had the right-of-way? That’s always crucial to know, but it’s far from the only factor worth investigating. In fact, it’s possible for someone to have the right-of-way and still be in the wrong.

For example, I’ve seen countless examples of pedestrians being in the road when or where they shouldn’t be. However, investigations would go on to show the driver who hit them was drunk, on their phone, or going at unsafe speeds and otherwise would have been able to avoid the accident. In those situations, would a driver get to ride off into the sunset simply because they had the right-of-way? Of course not. That would be ridiculous.

In other words, the law is nuanced enough that the whole context needs to be considered in these situations. As such, investigations should focus on gathering as much evidence as possible so there’s a clear understanding of how the accident could have been avoided.
