How Did This Accident Occur?

On a road like this, people might think everything comes down to who had the right-of-way. That’s obviously an important factor. If a pedestrian walks out into the middle of traffic, even a safe, attentive driver might not be able to avoid them. However, finding out if the accident was avoidable at all is often the most important factor. Even outside of a crosswalk, a driver can end up responsible for an accident.

For example, if someone is in the middle of a roadway, but they’re clearly visible and far away enough to avoid hitting, drivers have a responsibility to avoid hitting them. Failing to do so would raise serious questions about what that driver was doing that prevented them from slowing down or going around the pedestrian.

So, how avoidable was this accident, and did the driver or did they not have a reasonable chance of avoiding a collision? That will be up to investigations to say for sure.
