Commentary by Attorney Michael Grossman

In the absence of clear facts about an accident, I have found that some people turn to guesswork to fill in the blanks. Comment sections about this crash already contain theories about (and against) both the driver and the pedestrian, ranging from speeding to distraction to intoxication.

Could any of those factors be involved? Maybe. I wasn’t there and I don’t claim to know better than investigators. I do at least know that no explanation can be taken for granted. The bare-bones details available at this point mean it’s much too early for anyone to start reaching conclusions. Investigators still have many variables to consider: Vehicle condition, visibility and sightlines, weather, road conditions, potential medical complications, proximity to traffic controls and crosswalks…the list goes on, and until these and other issues have been properly considered it’s still anyone’s guess what happened out there.

I understand the desire to make sense of this unfortunate event as quickly as possible, but with only the published details that can’t be done effectively. Until investigators are able to better describe the cause and circumstances of the collision I must discourage speculation. The focus should instead be on how best to help the victim’s loved ones in their time of loss.
