Commentary by Attorney Michael Grossman
Generally speaking, people are likely to consider what happened here as a matter between the driver involved and the pedestrian. That’s pretty obvious, but what’s often overlooked is that properties sometimes play a role in serious accidents. What is visibility like here? Are there issues that would clearly create a hazard for pedestrians? Is there a lack of lighting in the area? Perhaps circumstances surrounding this accident would show there was nothing about the property that had any significance to the incident. That said, if authorities haven’t considered these possibilities, they could be overlooking something important.
