How Did This Accident Occur?
When a single vehicle crashes at 1:30 in the morning like this, it’s easy to assume it happened because the driver was fatigued, but investigators can’t afford to rely on guesswork. This crash deserves a full investigation like any other accident.
What if another vehicle forced the Volkswagen into the barrier? What if the Volkswagen had a problem with its brakes or steering mechanism? These are the kind of questions that investigators should consider as they work to reconstruct this crash, using physical evidence, witness statements, data from the Volkswagen’s engine control module and any available video footage.
An independent expert likely will need to examine the Volkswagen if authorities suspect a mechanical issue contributed to this crash, since in my experience most law enforcement agencies don’t have the time or training for such inspections.
Once completed, this investigation should provide the injured driver and his family with a clear picture of what happened on I-40.
