Commentary by Attorney Michael Grossman
When I read about a crash like this at an intersection, especially one involving a box truck and a passenger vehicle, the first thing I think about is whether the intersection itself may have contributed to the collision. Intersections are among the most dangerous places on the road, often due to issues like unclear right-of-way, limited visibility or driver error.
One critical question is what caused these vehicles to collide. Did one of the drivers fail to yield? For instance, was the box truck driver attempting to cross or turn onto Highway 72 without a clear understanding of the traffic flow? Or did the Toyota SUV have the right of way, and the truck failed to stop? Understanding the sequence of events will depend on evidence like skid marks, vehicle positions and witness statements.
Another important factor is whether the intersection is adequately designed and maintained. Does it have clear signage, functioning traffic signals or any warning indicators to prevent confusion or misjudgment? If the intersection has a history of collisions, it could point to underlying safety issues that require attention.
Driver behavior will also play a key role in the investigation. Was either driver distracted, speeding or otherwise impaired? Cell phone records, toxicology reports and surveillance footage, if available, could provide clarity about what happened in the moments leading up to the crash.
Finally, I can’t ignore the possibility that vehicle condition played a role. Did the box truck have properly functioning brakes and signals? Was the SUV in good working order? Mechanical issues, particularly in commercial vehicles, can lead to devastating outcomes in crashes like these.
For those impacted by this crash, including the affected families, finding out exactly what went wrong is essential. A thorough investigation can uncover the truth, hold the responsible parties accountable and potentially lead to changes that make the intersection safer for others in the future.
