Commentary by Attorney Michael Grossman

To be rather blunt, the first thing that came to my mind—and that surely came to everyone else’s minds—is this crash likely involved alcohol. Of course, that hasn’t been confirmed yet, and it’s important investigators consider the evidence and avoid jumping to conclusions. Here’s why.

For one, let’s say this happened due to unusual circumstances. Here in DFW, for example, we had a tollway that saw an unusually high number of wrong-way drivers due to warning signs that were installed too high. They were lowered, and the number of wrong-way driving incidents went down. Perhaps this crash involved something unusual, as well. A medical episode, bad lighting, lack of clear signage, etc.

Secondly, though, let’s say this was yet another drunk driving crash. People rarely get on the wrong side of the interstate after one too many drinks. They usually do so after becoming extremely intoxicated. That raises the possibility a local bar unlawfully over-served that person and put them in the position to get themselves or someone else killed. That would call for investigations into that alcohol provider and whether or not they’re responsible for contributing to the fatal crash.

One way or another, these accidents are almost never simple or straight-forward. It’s important that investigations are thorough enough that even factors that aren’t immediately apparent get attention. At the very least, those affected by this crash deserve answers.
