Commentary by Attorney Michael Grossman
When crashes like this one occur, people often assume they stem from a single mistake made in the moment. However, in my experience, accidents involving large trucks rarely have simple explanations. Instead, they often involve multiple factors that demand thorough investigation to fully understand what went wrong.
What caused the dump truck to cross into oncoming traffic, leading to this deadly collision? Was the driver distracted or fatigued, impairing their ability to safely control the vehicle? Driver fatigue, in particular, is a persistent issue in the commercial driving industry and can result in delayed reaction times or outright lapses in attention. Alternatively, mechanical issues like brake failure or steering malfunctions could have played a role, leaving the driver unable to keep the truck in its lane.
The trucking company that owned or operated the dump truck should also be part of the investigation. Companies are responsible for keeping their vehicles in roadworthy condition and ensuring that their drivers are properly trained and monitored. Was the dump truck maintained to an acceptable standard, or did a preventable failure like worn brakes or faulty steering contribute to this crash? Additionally, companies have a duty to hire competent drivers and provide them with the training and resources necessary to operate safely. Investigating these factors could help determine if failures at the company level played a role in the crash.
Ultimately, the goal is to uncover the truth and provide answers to those affected by the accident. Even if it requires conducting an independent investigation to obtain critical evidence, it’s essential to examine every factor to ensure those impacted by the incident receive the clarity and closure they deserve.
