Commentary by Attorney Michael Grossman

When I read about a crash like this one, involving an 18-wheeler crossing into oncoming traffic, I’m reminded that incidents involving alleged mechanical issues are rarely as simple as they might first seem. While the initial reports suggest that the truck veered left due to its brakes activating unexpectedly, determining how and why that occurred will require a thorough investigation.

One critical question is whether the truck’s brakes were properly maintained. Commercial trucks undergo significant wear and tear, making regular inspections and maintenance essential to ensure they are roadworthy. Investigators should examine the vehicle’s maintenance logs and service records to determine whether the trucking company adhered to these responsibilities. If they neglected routine maintenance or failed to address known issues, the company may share responsibility for the collision.

It’s also important to evaluate whether the driver performed the required pre-trip inspection to identify potential issues before hitting the road. Drivers are obligated to check critical systems, including brakes, to ensure their vehicle is safe to operate. If the brakes showed signs of trouble that were ignored or overlooked, it raises questions about the adequacy of the driver’s training or the company’s safety protocols. Investigating these concerns is central to coming to a full understanding of who might share responsibility in cases like this.

Additionally, the possibility of a manufacturing defect should not be overlooked. If the brakes failed due to a flaw in their design or production, the manufacturer may bear some liability. Forensic examination of the brake system will be essential to rule out this possibility and ensure that any contributing factors are identified.

Ultimately, the goal is to uncover the truth and provide answers to those affected by the accident. Even if it requires conducting an independent investigation to obtain critical evidence, it’s essential to consider every factor to ensure that those impacted by the accident receive the clarity and closure they deserve.
