Commentary by Attorney Michael Grossman

When accidents like this occur, particularly those involving a fatality and serious injuries, it is essential to conduct a thorough investigation to determine how and why the crash happened. In my experience, understanding the contributing factors behind a collision like this requires a careful focus on three critical questions.

First, did the authorities thoroughly investigate the crash? A situation where a vehicle crosses into oncoming traffic raises numerous questions that require detailed analysis. Investigators should assess physical evidence such as tire marks, debris, and the final positions of the vehicles to reconstruct the sequence of events. Witness accounts and any available footage from surveillance or dashcams could also provide crucial insights into the Challenger’s movements before the collision, including whether external factors, such as road conditions or driver actions, contributed.

Second, has anyone considered whether a vehicle defect might have played a role? Mechanical issues, such as brake failures, steering malfunctions, or tire blowouts, could cause a vehicle to veer uncontrollably into an opposing lane. A forensic examination of the Dodge Challenger is necessary to identify or rule out such issues. Additionally, reviewing the Ford F-250 for the performance of its safety systems, such as airbags and seat belts, is important to determine if they functioned as designed to protect its occupant.

Finally, has all relevant electronic data been collected? Modern vehicles like the Dodge Challenger and Ford F-250 are equipped with event data recorders (EDRs) that can provide vital information about speed, braking, and steering inputs leading up to the crash. This data could help clarify whether the Challenger’s movements were consistent with driver input or indicative of a mechanical failure. Any available footage from nearby cameras could also help establish the circumstances leading to the collision. Promptly securing this evidence is essential to preserving critical details.

Head-on collisions involving vehicles traveling on the wrong side of the road are often complex and require thorough investigation to identify all contributing factors. By addressing these questions, investigators can work toward providing a clearer understanding of what happened and why. For those affected by the crash, obtaining these answers is a necessary step toward understanding and closure. A comprehensive investigation is the least that can be done to ensure every possible factor is carefully examined.
