Commentary by Attorney Michael Grossman

When accidents like this occur, it’s easy to assume they’re caused by momentary lapses in judgment or misjudging traffic conditions. However, based on my experience, crashes involving large trucks often involve multiple contributing factors that demand closer examination.

Why might an 18-wheeler fail to slow down appropriately for stopped traffic on the highway? Was the driver distracted, fatigued, or otherwise impaired? Distraction can come in many forms, from a glance at a phone to monitoring GPS or even daydreaming. Fatigue is another critical consideration—did the driver exceed their legally allowed hours of operation? Even a few extra minutes of driving while tired can dull reaction times, making it nearly impossible to avoid stopped vehicles in time.

Mechanical issues should also be investigated. Did the truck’s braking system fail or underperform? Heavy commercial vehicles require well-maintained brakes to come to a stop safely, especially when carrying heavy loads. If the brakes were worn out or improperly maintained, that could be a key factor in the crash. Maintenance records could reveal whether the trucking company fulfilled its obligation to ensure the vehicle was roadworthy.

The trucking company’s role in this situation also warrants scrutiny. Were they diligent in ensuring their driver was adequately trained, rested, and operating in compliance with safety regulations? Did they enforce strict maintenance schedules for their fleet? If not, their negligence may have contributed to this accident. Companies must create and maintain systems that prioritize safety over efficiency, and failing to do so puts everyone on the road at risk.

Ultimately, the goal is to uncover the truth and provide answers to those affected by the accident. Even if it requires conducting an independent investigation to obtain critical evidence, it’s essential to examine every factor to ensure those impacted by the incident receive the clarity and closure they deserve.
