Commentary by Attorney Michael Grossman

Crashes in construction zones often involve factors that aren’t immediately obvious from the scene alone. In my experience handling truck accident cases, these areas create unique risks that make investigating what happened more complicated than in a typical highway crash.

One of the first things investigators should determine is whether the construction zone itself played a role. Was the lane pattern clear, or did poor signage and confusing traffic shifts contribute to the collision? Were there sudden slowdowns that caught drivers off guard? Road work often forces drivers to make quick adjustments, and if warnings aren’t adequate, even the most careful drivers can find themselves in a dangerous situation.

Another key question is whether the truck drivers involved were operating their vehicles safely. Commercial trucks require significantly more time to slow down than passenger cars, and in a construction zone, where traffic is often unpredictable, maintaining a safe following distance is critical. Investigators should review dashcam footage, electronic logging device (ELD) data, and witness statements to determine whether excessive speed, distraction, or following too closely contributed to the crash.

The role of the trucking companies involved should also be examined. Were the drivers given realistic schedules that allowed them to drive safely through work zones, or were they under pressure to meet deadlines that encouraged risky behavior? If company policies incentivize speed over safety, that could be an important factor in determining responsibility.

Finally, mechanical failure is another consideration. Were the trucks properly maintained? A brake failure, steering issue, or tire blowout could have made it difficult for a driver to navigate the construction zone safely. Reviewing maintenance records and post-crash inspections will help determine whether mechanical issues played a role.

Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Even if it requires conducting an independent investigation to obtain critical evidence, it’s essential to examine every factor to ensure those impacted by the incident receive the clarity and closure they deserve.
