Commentary by Attorney Michael Grossman

There is a lot we don’t know at this point, but this crash highlights the complexity of multi-vehicle collisions, especially when a semi-truck is involved. Determining liability in such cases requires understanding the sequence of events and identifying any contributing negligence. Here are some key questions that can be examined in this case:

Chain of Causation: Figuring out who is to blame for this crash will hinge on identifying which party initiated the crash and whether the ensuing collisions were avoidable or inevitable.

Actions of the Car That Collided with the Truck: What caused the car to collide with the semi-truck? Was the car following too closely, changing lanes recklessly, or distracted? Witness statements, dashcam footage or nearby traffic cameras could clarify whether the car’s driver acted negligently.

Truck Driver’s Actions: After the car collided with the truck, did the truck driver respond appropriately? Did they have adequate training and experience to handle the situation? Investigators will examine whether the truck driver was traveling at a safe speed, keeping a proper distance from other vehicles, or distracted in any way before the collision. Maintenance records for the semi-truck will be critical in determining whether mechanical issues, such as brake failure, contributed.

Road Conditions and Design: Was the guardrail placement or road design a factor in exacerbating the crash? Poorly maintained or poorly designed roadways can lead to more severe outcomes in accidents.

Injury Severity and Occupant Safety: Did the injuries in this case result from the initial collisions, or were they secondary impacts caused by the chain reaction? Investigators should consider whether the injured parties were properly restrained and whether vehicle safety features performed as expected.

To fully understand what caused his crash, investigators must examine a range of evidence, including witness statements, traffic camera footage and skid marks and debris patterns at the crash scene. Authorities also should scrutinize data from the vehicles’ engine control modules, which can reveal information about speed, braking and driver inputs before the crash. Vehicle maintenance records can help rule out mechanical failure as a contributing factor.

A thorough investigation will be critical to uncovering the sequence of events and understanding the role of each party. If authorities cannot answer the questions I’ve laid out to the satisfaction of those involved in this crash, perhaps an independent investigation may be warranted. Commercial vehicle accidents are so complex in my experience that outside investigators usually do a better job of getting to the bottom of what happened.
