Commentary by Attorney Michael Grossman

To be rather blunt, I find it challenging to come up with a scenario here where the truck driver didn’t make a huge mistake. There could be unusual circumstances to consider, of course, such as someone driving without their headlights on, for example. But when I look at this stretch of road, I don’t really see a place where a driver can make a u-turn without having to yield to oncoming traffic. So does that mean this truck driver cut off the victim? Are there features of this road I’m not seeing?

As often as crashes like this are the result of a negligent truck driver not keeping a proper lookout for a motorcycle rider, I can’t say what did or didn’t happen here. However, I do want to emphasize just how important more thorough investigations will no doubt be going forward. That’s true of any fatal truck wreck, but one involving a motorcyclist can be particularly delicate.

This is due to the unfortunate reality that many people are quick to blame motorcyclists just because they think all motorcyclists are reckless. Even without evidence suggesting a rider did anything wrong, people can jump to conclusions based on their own biases. Even the authorities can let this unfair characterization negatively impact their investigations if there aren’t more experienced investigators ensuring the facts can speak for themselves.

As such, my hope is authorities are not letting any sort of bias stand between them and getting the facts. Whether this was indeed some reckless truck driver or an unusual, unavoidable accident, it’s important to let the evidence speak for itself. That way, the victim’s loved ones can at least know they’re getting the whole story.
