Commentary by Attorney Michael Grossman
When crashes like this occur, people may assume the circumstances are simple or straightforward. However, in my experience, incidents involving hit-and-run drivers, particularly those involving large commercial vehicles, often raise questions that demand thorough investigation.
What could have caused the collision between the motorcycle and the rear-end of the commercial vehicle? Was the truck moving slowly or even stopped on the tollway for some reason? Did the motorcyclist misjudge the truck’s speed, or did the truck make an unsafe maneuver, such as cutting into the motorcyclist’s path? The fact that the truck allegedly fled the scene makes these questions all the more urgent, as it implies an attempt to evade responsibility. Tracking down the truck and its driver will be key to understanding how this fatal wreck unfolded.
The trucking company associated with the commercial vehicle also warrants scrutiny. Companies are responsible for ensuring that their vehicles are roadworthy and their drivers are properly trained and monitored. Was the driver complying with traffic laws, including maintaining proper speeds and lane positions? Did the company adequately vet and supervise the driver? Furthermore, companies that fail to prioritize safety—by pressuring drivers to meet tight delivery schedules, for instance—can create conditions that lead to reckless or negligent behavior on the road.
In cases of hit-and-run accidents, people may feel the driver is unlikely to be caught. However, commercial vehicles are often easier to track down than private cars. Many are equipped with GPS tracking systems, and witnesses may recall identifying details such as logos or license plates. Investigators can also use debris from the scene to match the truck’s make and model. With diligent effort, identifying and holding the responsible party accountable is more achievable than it might seem.
Ultimately, the goal is to uncover the truth and provide answers to those affected by the accident. Even if it requires conducting an independent investigation to obtain critical evidence, it’s essential to examine every factor to ensure those impacted by the incident receive the clarity and closure they deserve.
