Commentary by Attorney Michael Grossman
When I read about a crash like this, my first thought is that I hope the injured motorcyclist is receiving the care he needs and that a thorough investigation is underway to determine how this collision occurred. Motorcycle crashes involving passenger vehicles, especially at night, often result in serious injuries and are rarely as straightforward as they may initially appear. To truly understand what happened on Dalewood Place, we need to ask three critical questions.
First, did the authorities thoroughly investigate the crash? In any motorcycle-versus-vehicle collision, identifying the point of impact, direction of travel and visibility conditions is crucial. What were the lighting conditions in the area? Was either vehicle turning or entering the intersection at the time? Did the motorcyclist have the right-of-way, and was speed a factor for either party? A comprehensive reconstruction should include measurements of skid marks, road debris, impact angles and witness statements, if available, to establish the sequence of events.
Second, has anyone considered whether a vehicle defect may have contributed to the crash? The 2012 Kawasaki Ninja ZX and the 2013 Ford F-150 should both be examined for potential mechanical or safety system failures. On the motorcycle, a failure in the brakes, steering or suspension could have compromised the rider’s ability to avoid the crash. Similarly, if the F-150 had issues with its lights, turn signals or braking system, that could have played a role. These types of failures often go undetected unless both vehicles are preserved and inspected by experts.
Finally, has all the electronic data related to the crash been collected? While motorcycles typically offer limited onboard data, the Ford F-150 likely contains an engine control module that can provide pre-crash information such as speed, braking activity and throttle input. This data can help confirm the actions taken by the driver in the moments before impact. Additionally, if any nearby homes or businesses have surveillance footage, or if either vehicle had a dashcam, that footage could be critical to verifying the circumstances of the crash. These sources of evidence are time-sensitive and should be preserved quickly.
Crashes like this demand a careful, fact-driven investigation. A man was seriously injured, and in any collision involving a motorcycle, the margin for error is small and the consequences significant. Only by asking the right questions, preserving the vehicles and reviewing all available evidence can we provide a complete and fair explanation of what happened, and ensure that the injured rider and all others involved receive the clarity and accountability they deserve.
