Commentary by Attorney Michael Grossman
After any serious collision, particularly those involving motorcycles, the immediate focus is often on emergency response. But once the sirens fade, important questions still need answers—questions that can shape accountability, inform recovery, and prevent future harm.
Did the authorities thoroughly investigate the crash?
What stands out most right now is how little is known. When a motorcycle and a car collide, determining how that happened requires more than a surface-level review. Ideally, investigators would document the entire scene using precise tools like laser mapping, reconstruct vehicle paths, and gather details about each driver’s conduct leading up to the impact. But not all investigations reach that level. Whether due to limited resources or varying officer training, some crash scenes don’t get the scrutiny they warrant. That makes it harder to establish exactly what took place.
Has anyone looked into the possibility that a vehicle defect caused the crash?
Motorcycles and passenger cars both rely on complex mechanical systems, and something as small as a faulty brake, stuck throttle, or lighting malfunction can shift the entire picture of what occurred. These possibilities rarely show themselves without a close inspection, and if investigators don’t secure both vehicles for a thorough mechanical review, potential contributing factors could go unnoticed.
Has all the electronic data relating to the crash been collected?
Modern vehicles—especially passenger cars—carry onboard data systems that log speed, braking, and other critical information. In many cases, phones, GPS systems, or even nearby traffic cameras can also shed light on events just before impact. But unless someone requests and secures this data early, those digital clues may be lost. That’s a missed opportunity for clear answers.
When an incident leaves someone badly hurt and the facts remain uncertain, surface-level explanations aren’t enough. It’s worth asking whether all the right questions are being pursued, because that’s the only way to arrive at real understanding.
Takeaways:
- Some crash investigations fall short if they don’t include full scene reconstruction or expert review.
- Mechanical issues in either vehicle could have contributed but may not be checked without cause.
- Vehicle and phone data can clarify what happened, but only if someone secures it early.
