Commentary by Attorney Michael Grossman
What most people don’t realize when it comes to truck accident investigations is is that there is often much more to it than meets the eye. In my thirty years of litigating truck accidents, I have seen time and time again how investigations often fail to look beyond the crash scene in order to see the whole picture.
Driver fatigue is a known hazard, particularly in professions requiring long hours such as truck driving. In this instance, the driver admitted to falling asleep before striking the tow truck operator. This acknowledgment raises questions about the hours preceding the accident. Was the driver adhering to regulated driving hours? What measures did his employer have in place to monitor and enforce these regulations? I ask these questions because professional drivers don’t just fall asleep for no particular reason.
It’s important to consider whether the driver was under pressure to meet deadlines that may contribute to skipping necessary breaks or pushing beyond safe driving limits. These factors are not just about individual responsibility but also about company practices that might prioritize schedules over safety.
The point that I am trying to make here is that the facts that can be gathered at the crash scene are just a few pieces of the puzzle. The victim’s loved ones deserve to have the closure that comes with knowing the whole story, and that won’t happen unless the investigation is thorough enough to look beyond the scene itself and into the reasons behind the driver fatigue that ultimately took a life.
