Commentary by Attorney Michael Grossman

One of the bigger challenges with serious car accidents is people think authorities conduct exhaustive investigations, give victims and families all the answers they need, and victims and families use that to get a fair resolution. A lot of the time, though, authorities don’t prioritize the needs of victims and families. They’re just looking for charges to file. It can be important, then, to follow up with authorities and find out what efforts they’ve made on their own.

Did investigators have the time and resources to properly analyze the crash? Law enforcement agencies are often stretched thin, and accident investigations can take a backseat to other responsibilities. If officers didn’t have the tools or training needed for a thorough reconstruction, crucial evidence could have been overlooked.

Did authorities consider whether a vehicle defect played a role? A mechanical failure, such as brake or steering issues, could have contributed to the crash. Additionally, defects in safety systems—like malfunctioning seatbelts or airbags—can turn survivable crashes into fatal ones. These factors often require specialized analysis beyond what standard accident reports include.

Did investigators collect all available electronic data? Modern vehicles store crucial information about speed, braking, and driver actions before impact. Additionally, traffic cameras, dashcams, and nearby security footage may have captured the crash. If this data isn’t gathered quickly, it may be lost, leaving unanswered questions about what truly happened.

If authorities can provide thorough, clear answers to these questions, they likely took investigations seriously. Otherwise, if they seem to fall short of expectations, that may be a sign that the crash needs a second look from more thorough independent investigators.
