Commentary
I get calls about fatal work accidents a lot, and it’s usually from families surprised because they thought there was an automatic process following a work accident to resolve things. Texas, though, has the most complex work fatality law of any other state due to the fact employers are not required to subscribe to the workers’ comp system. That means after accidents like this, there may not be a guaranteed path to a resolution. Add on top of that the inherent challenges of investigating a work site, a company’s safety procedures, training records, history of accidents, and behavior of employees from 3rd party companies involved in an accident. That’s why families affected by fatal work accidents in Texas generally need more help navigating this legal maze than people in other states.
