Commentary by Attorney Michael Grossman
When it comes to alleged drunk driver accidents, folks sometimes think things are open-and-shut. The drunk driver gets charged, and that’s that, right? In reality, things can be a lot more complex than that—if handled properly. That’s because there’s usually a complicit alcohol provider who may also need to be held accountable for contributing to the accident.
Put simply, alcohol providers in Texas who unlawfully over-serve someone who is obviously intoxicated can face potential criminal investigations, fines, suspended licenses, and liability for resulting injuries. But if authorities put all of their focus on the alleged drunk driver, negligent alcohol providers can easily slip through the cracks. I’ve handled hundreds of cases against negligent alcohol providers, and authorities simply don’t prioritize investigating them on their own all that often. We’ve had plenty of cases where authorities only pursued charges after we gave them evidence from our own investigations on a silver platter. Perhaps authorities here have been more thorough behind the scenes, though. It would certainly be a welcome step in the right direction toward making our roads safer for everyone.
