Commentary by Attorney Michael Grossman
In their statements, authorities allege that the driver of the pickup smelled of alcohol and had been drinking, though this remains unconfirmed. If evidence shows alcohol was a factor, however, I’d hope to see authorities continue their investigations into where that alcohol came from.
I had a personal injury case against a bar recently that had details similar to these. In that situation, a family was driving around, minding their own business, when a drunk driver turned into oncoming traffic and hit them head-on, seriously injuring a young kid. As we investigated the events, we found out the man had been drinking at a local bar. That’s how it came to light that the bar recklessly over-served the driver.
Evidence showed the man had been drinking with co-workers at a happy hour. During just a couple of hours, the bartenders served him drink after drink without any limit. By the time he was done, he could barely stumble out the door, let alone drive safely. With that evidence, it was clear that bar broke the law and was responsible for contributing to the crash.
Maybe nothing like that happened here, but it’s important to let the evidence speak for itself. That can’t happen if investigators aren’t looking for that evidence.
