Commentary by Attorney Michael Grossman

While the cause of the crash can’t be confirmed, authorities mentioned that they believe the driver had been drinking. To be clear, I don’t know if that’s true, and they did not say the driver was legally intoxicated. If they had, there would probably also be an investigation into where the alcohol came from and whether or not a business such as a bar is responsible for illegally over-serving the driver. Having handled hundreds of personal injury cases against bars and stores all around the state, I can attest to just how tragically common that sort of thing is.

With that said, authorities don’t mention charges, they don’t include any sort of test results, they don’t accuse the driver of being intoxicated, and they don’t mention where they’re getting their conclusions from. So for all we know, this all is just speculation. It seems clear there’s a lot more to this story, but is that because authorities withheld details, or is it because they made a mistake?
