Commentary by Attorney Michael Grossman

Authorities claim that the driver of the vehicle left the scene after the accident. They also mentioned alcohol as a possible factor in the accident. I can’t confirm any of these details right now, but any possibility of drunk driving is important to consider. That’s not just for potential consequences for the allegedly drunk driver, but there could also be a local alcohol provider responsible for the accident.

My concern, though, is that authorities tend to overlook the possibility of a complicit alcohol provider. Their priority isn’t always aligned with getting victims and families answers or help after an accident. There priority is to find out if anyone can face charges. Once that happens, they tend to just move on. That’s why in many of the hundreds of cases I’ve handled against negligent alcohol providers, our clients never heard anything about a potential complicit alcohol provider until we brought it up.

It’s unfortunate that so many people are left in the dark about their options just because there isn’t enough public discussion about these areas of the law. Even if those options don’t apply to this specific crash, it’s important these possibilities get attention even if it’s just to rule them out. It remains to be seen if those steps have been taken here.
