Austin, TX — August 3, 2024, Mellany Baca and a man were injured following an alleged drunk driver accident at around 3:12 a.m. on I-35.

According to preliminary details from authorities, the accident happened along southbound lanes of the interstate near East 51st Street.

Investigators said that 21-year-old Mellany Baca was a passenger on a Suzuki motorcycle driven by a man, also 21. As they were going along I-35, it appears the motorcycle lost control and fell over, throwing both riders into the roadway. Due to this, Mellany Baca and the man both sustained reportedly serious injuries. Authorities allege that the man operating the motorcycle was under the influence of alcohol.

If what authorities are saying here is true, then it’s likely there will be consequences for these actions. However, folks don’t often know that those consequences can extend beyond the drivers involved in these situations. This is because alcohol providers can be responsible when an accident results from them illegally over-serving someone.

If someone is obviously intoxicated, and an establishment serves them, they’re breaking the law. This exposes them to potential criminal investigations, fines, license suspensions, and liability when that driver gets themselves or someone else hurt. While it’s not clear if that would apply here, it’s very common at this hour of the day. As such, it would be irresponsible not to consider the possibility there’s someone out there responsible for all of this who isn’t answering for their actions.
