Commentary by Attorney Michael Grossman

After such a chaotic accident, one thing that comes to mind is whether or not authorities maintained custody of the vehicle. Something that too often goes overlooked following deadly car accidents is vehicle data as well as possible vehicle defects.

I can’t count how many times I’ve had a case where the authorities never had an accident reconstruction pull Engine Control Module data (which can show things like speeds and braking leading up to the crash), and they never examined the vehicle for potential defects that may have caused the accident. This evidence can be time sensitive, and it usually requires experienced, well-equipped specialists to properly analyze the evidence.

This is why I discuss these often-overlooked details. The sooner they get attention, the better. A grieving family deserves answers, and that means ruling out even relatively uncommon possible factors. With the victims not here to give their side of the story, it’s even more important there’s as much evidence as possible getting attention from experienced investigators.
