Commentary by Attorney Michael Grossman

With any serious accident, it’s important to know how the crash is being handled. It would surprise folks how often I speak to families who feel they were misinformed or weren’t given the whole story following a serious accident. That’s why it can help families to be proactive and ask some key questions to gauge if authorities are coming up short in their efforts.

First, did investigators have the tools, training, and time needed to fully analyze the crash? Were officers able to document the scene thoroughly, including tire marks, points of impact, and any potential hazards? Did they assess environmental factors like lighting or weather? Without a detailed investigation, important aspects of the crash could remain unclear.

Second, has the possibility of a vehicle defect been explored? A mechanical failure, such as steering issues, brake malfunctions, or tire blowouts, could cause a driver to lose control and drift into oncoming traffic. Furthermore, safety equipment failures, such as seatbelts or airbags, could worsen the severity of the injuries sustained by those involved. A forensic inspection of both vehicles is critical to determine whether any defects played a role in the collision or its aftermath.

Finally, have investigators preserved and reviewed all available electronic data? Both vehicles likely have Engine Control Modules (ECMs) that record critical information like speed, braking, and steering inputs leading up to the crash. Additionally, GPS data or video footage from nearby cameras may provide valuable context to help clarify what happened. Securing this evidence promptly is essential to ensure nothing is lost or overlooked. Even cellphone data can slip through the cracks, since it sometimes requires authorities to go through the courts, and officers aren’t always going to go to those lengths on their own.

By asking these questions, authorities have an opportunity to come forward and show they were thorough in their efforts. This can help reassure victims and families that they’re getting the answers they need. Other times, though, authorities are unable to provide, convincing or sensible answers. That’s when steps can be taken to ensure there’s another set of eyes looking things over to catch whatever authorities may have missed.
