Commentary by Attorney Michael Grossman

A lot of folks think 18-wheeler accidents are just big car accidents, and authorities are on top of them whenever they come up. In reality, they can involve all kinds of unique challenges, and it takes extensive, thorough investigations to keep all the facts straight. Without that, things get lost in the shuffle, and sometimes the story gets warped.

For example, I had a case a while back involving a woman crashed with an oncoming 18-wheeler. She wasn’t able to give her side of the story at the scene, and the officer essentially just asked the truck driver what happened. As a result, the official report said the woman crossed the center line and hit the truck. Through independent accident reconstructions, though, the facts told a different story. The 18-wheeler actually was going too fast, the trailer became unstable, and it wobbled and swung across the center line, causing the collision.

Now to be clear, I’m not saying that happened here. My point is it took independent investigations to set the record straight because it turned out authorities hadn’t actually done a proper, thorough investigation. That’s why when folks hear from authorities, they should consider the kind of information they’re getting. If it seems like authorities are able to offer a clear explanation of what happened and have evidence to support their findings, it’s likely they did a good job and took the investigations seriously. But if folks are left with doubts, and authorities aren’t able to provide sensible, satisfactory explanations for what happened, it could be a sign that investigations may have bee mishandled.
