Matthew Hooker Alleged Drunk Driver Accident in Montgomery County, TX

It appears that 22-year-old Matthew Hooker was a passenger in a pickup being driven northbound on F.M. 149. That vehicle apparently ran off the side of the road, went through the ditch, and crashed into a fallen tree along the side of the road. Due to this, Hooker was killed. The driver was reportedly in stable condition.

Commentary by Attorney Michael Grossman

The pickup driver is reportedly being charged for intoxication manslaughter in relation to the crash. If the allegations are true, then this could be a lot more complex than just a single driver facing potential charges. It’s very possible there’s an accomplice to all of this who also needs to be held account: an alcohol provider.

This is due to alcohol providers being responsible when they illegally over-serve someone who then gets someone hurt or killed due to their intoxication. They can face potential criminal investigations, fines, license suspensions, and even liability for the resulting harm. Unfortunately, this is not the sort of thing authorities tend to look into on their own. I’ve handled hundreds of cases against negligent alcohol providers involved in serious accidents. It’s not often that our investigations happen parallel to a police investigation unless we’re the ones that put the alcohol provider on their radar.

In recent years, though, some jurisdictions have become more motivated not just to hold intoxicated drivers accountable but also any negligent alcohol providers who contributed to a serious accident and who could continue to put lives at risk unless they’re put on the straight-and-narrow. It’s just not something anyone should take for granted. It would be encouraging to hear otherwise that authorities here aren’t just limiting their investigations to evidence that was at the crash scene. Considering someone lost their life here, it’s important that all parties who had a hand in that face appropriate consequences.
