Commentary by Attorney Michael Grossman
My biggest concern in these situations is whether or not authorities gave the accident the attention it deserved. Single-vehicle wrecks aren’t often a high priority for them, which means they can overlook important details if they aren’t careful.
For example, I had a case not long ago where they blamed a driver for an accident, saying they weren’t wearing their seatbelt. The family, however, knew that was out of the ordinary, as the victim was very safety conscious. Well, further independent accident reconstructions revealed that the victim had a defective seatbelt. Despite wearing it properly, they were thrown from their seat. Authorities completely missed that and were ready to tell the family the victim was to blame for their own injuries.
I’m not suggesting that happened here, of course, but it’s the sort of thing that can happen without thorough investigations. If authorities here were able to answer all of the questions the victim’s family had, then they were probably thorough in their efforts. If there are still unanswered questions, though, then it may take more focused independent efforts to get those answers.
