Sibley County, MN — July 30, 2025, Mary Ann Ott was killed as the result of a semi-truck accident at around 7:20 a.m. along Highway 5.

Minnesota State Police say that the collision occurred at the intersection of Highway 5 and Highway 25.

Authorities say that 73-year-old Mary Ann Ott was on foot at the time and attempting to cross the highway. While doing so, a semi-truck was reportedly making a right turn onto Highway 25. The semi-truck somehow struck Mary Ann Ott in the process.

People may be thrown off a bit by this accident happening on a highway, but the same factors need to be considered as in any other fatal pedestrian accident. Ultimately, it’s important to know whether or not the truck driver could have reasonably seen and avoided the pedestrian.

A lot of people just assume pedestrian accidents are all about who had the right-of-way. Well, let’s consider a hypothetical.

If someone is crossing a highway, they’re clearly visible, and they’re far enough away that an attentive truck driver going at appropriate speeds could avoid them, would that truck driver have free rein to run over the pedestrian if the driver had the right-of-way? Of course not, that would be ridiculous. Similarly, if the truck driver had no reasonable way of seeing or avoiding the pedestrian, it would be ridiculous for them to be responsible for something they couldn’t avoid.

That’s why these preliminary reports leave a lot of unanswered questions. Was the victim visible? Was the truck driver paying attention to their surroundings? Would a reasonably prudent driver have been able to avoid this accident? Are there any other extenuating circumstances that make this accident unusual? If authorities haven’t worked to answer these questions, they could be missing something crucial.
