Commentary by Attorney Michael Grossman

Right now, there’s been no confirmation on whether authorities believe alcohol or drugs contributed to the accident. Believe it or not, that can be a significant distinction after an accident like this. This is because a lot of drunk driving accidents involve people who were unlawfully over-served by an alcohol provider, and those providers can be liable for their role in an accident.

Simply put, alcohol providers who over-serve someone that’s obviously intoxicated can potentially face criminal investigations, fines, suspended licenses, or liability for the injuries or deaths resulting from the intoxication. Not only does this ensure there are consequences for all wrongdoers involved in an accident, but it helps get those negligent alcohol providers to clean up their act before more people get hurt.

So while authorities may have one person facing charges here, there could still be more to the story. Hopefully authorities haven’t been too quick to move on before ensuring the victim’s loved ones will get a just resolution.
