Commentary by Attorney Michael Grossman

People often ask me about summaries like this because they’re surprised to see just how bare-bones they tend to be. Even when an OSHA case is considered closed, there may not be more than about a sentence or two about the accident. This is something I’ve shined a light on for years: OSHA is not always going to provide all the answers people need. Even the family may not be given much more information than the public.

As such, it’s usually more prudent to have independent investigators look into a work accident and make sure the family has as much information about the victim’s working conditions and the events leading up to the fatal incident. Texas has the most complex work fatality laws of any other state in the country. In my experience, families stood the best chance of getting a just resolution when they took steps as early as possible to prepare themselves rather than waiting around for an OSHA report that might not even do them any good.
