Commentary by Attorney Michael Grossman

When a vehicle is stopped in the middle of a freeway in the early morning hours and another driver crashes into it, the first question people often ask is why was that car stopped in the first place? In this case, authorities suspect that alcohol may have been involved—but at this stage, that hasn’t been confirmed. That uncertainty matters more than most people realize.

If alcohol did play a role in causing a driver to stop dangerously in an active lane of traffic, that’s not just an issue for that driver—it may point to broader accountability. Specifically, it’s worth asking whether someone over-served that driver after they were already showing signs of obvious intoxication. Under Texas law, alcohol providers have a legal obligation not to serve patrons who are clearly intoxicated. If they do, and a crash follows, they can and should be held accountable.

But that kind of accountability is only possible if investigators take the time to look at the driver’s condition, their actions leading up to the crash, and—critically—where they were drinking. These facts aren’t always easy to gather after the fact. That’s why early and thorough investigation matters—not just to understand what happened, but to make sure all responsible parties are held to account.

Key Takeaways:

  • If alcohol contributed to a dangerous decision behind the wheel, it’s important to confirm it through a full investigation.
  • Texas law allows negligent alcohol providers to be held accountable if they over-serve an obviously intoxicated person.
  • Establishing where the alcohol came from is essential—not just for justice, but for preventing future incidents.
