Commentary by Attorney Michael Grossman

A lot of folks think that pedestrian accidents are simple. They figure that the pedestrian either had the right-of-way, or they didn’t. As important as right-of-way is, it’s just one piece of the puzzle. A lot of times, it’s necessary to find out how avoidable the accident was. If something in the road isn’t visible or enters the path of an attentive driver going at reasonable speeds, there might not be any reasonable way to avoid a collision. But if someone is clearly visible and far away enough to avoid, a driver failing to do so would raise serious red flags. There’s not enough information here to say for how avoidable this was, but hopefully investigators have taken ample steps to leave no stone unturned.
