Paris, TX — April 30, 2024, Mark Callaway Jr. was killed as the result of an alleged drunk driver accident at around 9:12 p.m. on Evergreen Street.

Authorities said in preliminary statements that the accident happened at the intersection of Evergreen Street and Southeast 6th Street.

According to officials, 44-year-old Mark Callaway Jr. was on a bicycle going southbound on 6th Street. As Callaway was crossing Evergreen, it appears an eastbound vehicle struck Callaway, killing him. That driver was allegedly under the influence of alcohol at the time of the collision, and authorities recommended charges for DWI.

If these allegations are true, did the investigations from authorities simply end at the crash scene? In a lot of alcohol-related accidents, there’s also a bar or other alcohol provider involved. Unfortunately, authorities too often overlook their role in serious accidents.

Simply put, it’s illegal in Texas for alcohol providers to over-serve someone who’s obviously intoxicated. If they do so, it opens them up to all sorts of consequences, such as criminal investigations, fines, license suspensions, and civil liability should the over-service lead to people getting hurt. But I’ve handled hundreds of civil cases against negligent alcohol providers, and time and time again authorities aren’t anywhere to be found. We’ve even had times where we gave evidence to authorities of a bar’s wrongdoing, and they still never bothered investigating further.

To be clear, I can’t say what all happened here nor what steps authorities have taken beyond what they’ve said publicly. What I do know, though, is how often I’ve seen authorities let alcohol providers off the hook even after a fatal accident. Maybe they’re being more thorough here, but experience tells me not to hold my breath.
