Commentary by Attorney Michael Grossman

Right now, details allege that the driver of the vehicle had been under the influence of alcohol at the time and would be recommended charges for intoxication assault. It’s not for me to say if that’s true or not, however it raises a very serious question: Where did the driver get their alcohol from?

When crashes like this happen, all of the focus tends to go to the alleged drunk driver. That’s understandable, but a staggering amount of crashes like this happen in part because the driver was illegally over-served by a bar or some other alcohol provider. Those alcohol providers, then, need to answer for their own actions. This can be through criminal investigations, fines, license suspensions, or even liability for the injuries their actions led to. That way, there can be a focus not just on finding a bad guy to blame but rather seeing there is accountability for the harm the victims suffered.
