Commentary by Attorney Michael Grossman

When I read about a crash like this, my first thought is that I hope the injured driver receives the care she needs and that the investigation leaves no question unanswered. Rear-end collisions, particularly those that result in serious injuries, are often seen as routine, but in my experience, they deserve a much closer look. To truly understand what happened here, we need to ask three critical questions.

First, did the authorities thoroughly investigate the crash? A rear-end collision may seem straightforward, but it’s important to determine why the lead vehicle was slowing or stopping and whether the following driver had adequate time and distance to respond. Was traffic congested, or were there unexpected conditions at the intersection? Were the Nissan’s brake lights functioning properly? Did the Chevrolet Suburban driver fail to maintain a safe following distance or become distracted? A detailed crash scene analysis — including skid marks, vehicle rest positions and damage profiles — is essential to understanding what caused the impact and whether it could have been avoided.

Second, has anyone considered whether a vehicle defect may have contributed to the crash or its severity? Both vehicles involved should be inspected. For the Suburban, were the brakes functioning correctly? Did the tires or suspension contribute to delayed braking or reduced control? For the Nissan, which sustained the impact, it’s important to examine whether the seatbelts, airbags and headrests functioned properly to protect the driver. In cases of serious injury, even low to moderate-speed impacts can be exacerbated by failures in safety systems. These issues must be explored before either vehicle is repaired or discarded.

Finally, has all the electronic data related to the crash been collected? Both vehicles are likely equipped with engine control modules that can record vital pre-crash data such as speed, throttle input and brake use. That information could help determine how fast the Suburban was traveling and whether the driver attempted to brake. Additionally, dashcams, GPS devices or surveillance footage from nearby businesses may provide visual evidence of the crash and help verify the timing and context of the impact. As always, this data is time-sensitive and should be preserved quickly.

Crashes like this deserve more than the assumption that one car simply “didn’t stop in time.” A young woman was seriously injured, and she deserves a full, fact-based explanation of why that happened. By asking the right questions and securing all relevant evidence, we can ensure that those affected receive not only medical attention, but also clarity and accountability; things every crash victim and their family deserves.
