Commentary by Attorney Michael Grossman

A lot of people tend to see charges for drunk driving and assume everything is open-and-shut. In reality, alcohol-related accidents can present a unique challenge if investigations show the driver was over-served by a negligent alcohol provider.

Simply put, it’s unlawful in Texas for bars and other establishments to serve someone who is obviously intoxicated. Doing so exposes them to potential consequences, including criminal investigations, fines, and liability for injuries caused by the intoxication. Too often, though, this goes overlooked. Authorities tend to narrow their focus solely on drunk drivers. Meanwhile, there could be a local alcohol provider continuing to put lives at risk.

I’ve handled hundreds of cases against negligent alcohol providers. Holding them accountable gets them to clean up their act. So not only can victims and families get justice for the harms done to them, they can help ensure other families aren’t hurt in the future. That alone makes it worth conducting thorough investigations into crashes like this. Are those steps being taken here?
