An investigation is underway following a car accident that left one person dead and injured four others during the evening hours of January 20th. According to official reports, a Toyota Tacoma was traveling in the area of Harborside Dr. and 29th St. when it was struck by a BMW that going at a high rate of speed according to officials.
When first responders arrived on the scene they found that Maria Martinez was killed from her fatal injuries, while her husband and three children were seriously injured and transported to the hospital for treatment. The BMW driver has since been charged with intoxication manslaughter and intoxication assault, and more details from the accident may be released by authorities in the future.

When authorities report that a driver was intoxicated at the time of a crash, most people focus on the immediate consequences—especially when lives are lost and families are left to pick up the pieces. However, one of the most critical yet often overlooked questions is: Where did the driver obtain their alcohol?
From what’s been reported, the driver of the BMW was allegedly intoxicated and traveling at high speed when they struck another vehicle, leading to the death of the victim and serious injuries to her husband and children. While the criminal justice system will likely address the driver’s actions, it’s worth asking whether this situation could have been prevented in the first place.
Under Texas law, alcohol providers—such as bars, restaurants, and other establishments—are prohibited from serving alcohol to obviously intoxicated patrons. If a business continued to serve the driver despite clear signs of impairment, they could bear legal responsibility under Texas dram shop laws. Identifying where the driver was drinking before the crash is essential not just for accountability, but also to help prevent future alcohol-related crashes.
Unfortunately, these aspects of an investigation are often overlooked. Police reports typically focus on the driver’s actions rather than the source of their intoxication. That’s why independent investigations play a crucial role in uncovering whether an alcohol provider contributed to the circumstances that led to this crash.
