Denton County, TX — April 29, 2024, Marcus Ayers was injured following an alleged drunk driver accident at around 8:42 p.m. along Yacht Club Road.
Preliminary information about the accident says that it happened in the area of the Yacht Club Road and Martingale Trail.

Authorities said in their statements that 36-year-old Marcus Dalamar Ayers was on foot at the time along the side of Yacht Club Road. Details say a passing GMC Sierra struck Ayers, resulting in serious injuries. The driver was allegedly under the influence of alcohol at the time, and authorities recommended charges for DWI and intoxication assault. No further information is available at this time.

As authorities continue to look into things here, it’s important to know if they’re also considering where this alleged alcohol came from. Folks tend to only consider the actions of drunk drivers, who obviously deserve to face consequences for their actions. In Texas, though, alcohol providers who over-serve those drivers can also be on the hook for their role in an accident.
Too often, that’s something that slips through the cracks. I’ve handled hundreds of cases against negligent alcohol providers. Authorities in a lot of those cases simply never bothered looking into the possibility of a negligent alcohol provider, meaning they would have walked away without so much as a slap on the wrist had the victims not sought out help independent of the authorities. I’d like to think this isn’t one of those situations, but it would unfortunately be all too familiar.
