Commentary by Attorney Michael Grossman

In my experience, incidents involving 18-wheelers are seldom straightforward. When a truck veers off the road, as in this case, it raises several questions that require thorough investigation.

First, it’s essential to determine what caused the truck to lose its lane. Was the driver distracted, fatigued, or experiencing a medical emergency? Collecting data from vehicle event recorders, reviewing traffic camera footage, and analyzing witness statements can provide crucial insights.

Next, we must consider the trucking company’s role. Was the driver adequately trained and following safety protocols? Trucking companies have a responsibility to ensure their drivers are well-prepared for the demands of the road. If the company neglected proper training or pushed the driver to meet unrealistic deadlines, they could share responsibility for the incident.

Additionally, examining the truck’s condition is vital. Was the vehicle properly maintained? Mechanical failures, such as brake malfunctions or steering issues, can significantly contribute to accidents. Reviewing maintenance records and conducting thorough inspections of the vehicle can reveal if such problems were a factor.

Investigations should go beyond the crash scene to uncover the full story. This includes looking into the truck driver’s logs, evaluating their driving history, and possibly consulting with accident reconstruction experts.

Ultimately, the goal is to uncover the truth and ensure accountability. Whether through obtaining vital evidence or, should it become necessary, conducting an independent investigation, it’s crucial to consider every factor to deliver justice to those affected. A diligent investigation is essential to answer the remaining questions and provide clarity for everyone involved.
